DUI/DWI/DRUNK DRIVING OR DRIVING INTOXICATED OR IMPAIRED
In common language, people hear the terms “DUI”, “DWI” or “Driving Intoxicated” or “Driving Impaired”. Actually, they are all the same thing, essentially operating a motor vehicle while being impaired by alcohol or drugs.
The punishment if convicted of Driving Intoxicated can vary widely depending on such factors as whether it is a 1st Offense or 2nd Offense or 3rd or subsequent DUI or DWI is a felony and has mandatory prison time that MUST be served.
Also, if a persons blood alcohol level is .15 or above, mandatory jail time is imposed by the Court and required under the Code of Virginia. If a persons blood alcohol level is above .20, even more jail time is required.
Other issues also arise such as a 12 month loss of license, mandatory Alcohol and Substance Abuse Program and a mandatory ignition interlock.
