In common language, people hear the terms “DUI”, “DWI” or “Driving Intoxicated” or “Driving Impaired”.  Actually, they are all the same thing, essentially operating a motor vehicle while being impaired by alcohol or drugs.

The punishment if convicted of Driving Intoxicated can vary widely depending on such factors as whether it is a 1st Offense or 2nd Offense or 3rd or subsequent DUI or DWI is a felony and has mandatory prison time that MUST be served.

Also, if a persons blood alcohol level is .15 or above, mandatory jail time is imposed by the Court and required under the Code of Virginia.  If a persons blood alcohol level is above .20, even more jail time is required.

Other issues also arise such as a 12 month loss of license, mandatory Alcohol and Substance Abuse Program and a mandatory ignition interlock.

RECKLESS DRIVING

In Virginia, reckless driving is actually considered a criminal offense and is a Class 1 misdemeanor, which can be punished by up to 1 year in jail and the suspension of your license and a fine of up to $2,500. RECKLESS DRIVING BY SPEEDING

Although many reckless driving charges involve some type of reckless or negligent driving, Virginia also has a law making speeding over 20 miles above the speed limit or over 80 miles per hour, reckless driving.  Even though it is only a speeding violation, Virginia punishes it as a crime and it carries up to 12 months in jail and/or a $2,500 fine.

REDUCTION OF RECKLESS DRIVING CHARGE

The MAIN goal for most clients is getting the charge out of the Reckless Driving  category and changed to a reduced charge OR obtain a dismissal of the charge.  A reduction to Improper Driving or obtaining a dismissal can help a client enormously concerning insurance issues.
